{"id":4963,"date":"2026-04-01T00:00:19","date_gmt":"2026-04-01T05:00:19","guid":{"rendered":"https:\/\/memorialswordandshield.com\/?p=4963"},"modified":"2026-03-31T20:52:36","modified_gmt":"2026-04-01T01:52:36","slug":"anti-transgender-laws-worsen-across-america","status":"publish","type":"post","link":"https:\/\/memorialswordandshield.com\/es\/4963\/opinions\/anti-transgender-laws-worsen-across-america\/","title":{"rendered":"Anti-Trans Laws Worsen Across America"},"content":{"rendered":"<p>The state of Kansas has passed a law that directly attacks transgender people. Kansas has invalidated driver&#8217;s licenses that carry updated gender markers that align with a transgender person&#8217;s gender identity. This law also prohibits transgender people from using the bathrooms that align with their gender identity in government buildings, and allows people to sue someone for being suspected of being transgender. This is utterly insane. Being able to sue someone for potentially being transgender and expressing themselves makes it so that transgender people can not express themselves how they want to without fear of legal action against them.<\/p>\n<p>Bill SB 244 was first introduced back on February 5, 2025, but was vetoed by Governor Laura Kelly on February 16, 2026. However, on Wednesday, February 17-18, 2026, the House and Senate of Kansas agreed to override the veto by the governor, and the bill went into effect on February 26, 2026. Overnight, transgender citizens of Kansas who had changed their gender marker on their driver&#8217;s license had their licenses invalidated. There was no warning and no money to help them get these new licenses. Nothing\u2014 Just an overnight switch that took away part of their ability to express themselves.<\/p>\n<p>Bill SB 244 also makes it so that if a transgender person uses a bathroom in a government building that does not align with their sex, there could be civil or even criminal violations for that person. Along with that, it also allows anyone to take a private action against someone they assume to be transgender and sue them for \u201cdamages\u201d totaling up to $1,000. This takes away the right to their autonomy, forcing them to use the bathroom they might not want to.<\/p>\n<p>Despite governmental support, some people are fighting back. A lawsuit was filed challenging SB 244, filed in the District Court of Douglas County on behalf of the anonymous plaintiffs Daniel Doe and Matthew Moe. The lawsuit is being filed by the American Civil Liberties Union of Kansas, also known as the ACLU of Kansas, and Ballard Spahr LLD. According to the ACLU, the lawsuit claims that SB 244 is in violation of the Kansas state constitutional protections of personal autonomy, privacy, equality under the law, due process, and freedom of speech. But on March 10, 2026, a trial court denied the plaintiff&#8217;s request for a restraining order, meaning SB 244 is still in effect.<\/p>\n<p>Kansas isn\u2019t the first state to introduce such laws. According to the Trans Legislation Tracker, 113 bills have already been introduced. So far, only 22 of the bills in 9 states, including Wisconsin, have been passed. 7 of the bills are in Wisconsin alone; however, all 7 are still pending action. The bills in Wisconsin would potentially ban transgender people from sports, disallow name and pronoun changes in school, and ban minors from receiving gender-affirming care.<\/p>\n<p>The United States has been becoming a much more dangerous place for transgender people, but with these new laws, it\u2019s only getting worse. The more laws that are enacted, the more danger transgender people in. These laws will also affect more than just transgender people. Kansas SB 244 will allow people to sue someone for thinking they might be transgender. This could mean anyone suspected of being transgender will have to deal with legal action against them, even if they aren\u2019t transgender.<\/p>\n<p>The United States is currently a scary place. If you have any friends who are transgender or are being affected by any of the laws or political atmosphere in the United States, check in with them. Help them know they aren\u2019t alone in this fight. If you want to help in the fight for the safety and freedoms of transgender people, please call your representatives, vote if you can, and go protest.
